Terms and Conditions

1. Introduction

These Terms and Conditions («Terms») govern the use of the KOOMPASS marketplace by travelers («you,» «your»). By signing up or making a booking through our platform, you agree to comply with and be bound by these Terms. Please read these Terms carefully before using our services.

2. Registration and Account

  • You must provide accurate, complete, and up-to-date information when you sign up.
  • You are responsible for maintaining the confidentiality of your account information, including your password.
  • You must notify KOOMPASS immediately of any unauthorized use of your account.
  • KOOMPASS reserves the right to suspend or terminate accounts that provide false information or violate these Terms.

3. Services Provided

  • KOOMPASS offers a platform where you can browse, inquire about, and book travel experiences curated by local luxury active travel operators.
  • While KOOMPASS facilitates the booking process, the actual travel services are provided by third-party operators. KOOMPASS acts solely as an intermediary between you and these service providers.
  • KOOMPASS is not responsible for the delivery, quality, safety, or any other aspect of these services provided by third parties.
  • KOOMPASS makes reasonable efforts to select reputable service providers but makes no guarantees about their services.

4. Booking and Payments

  • When making a booking, you agree to provide accurate payment information and to pay all applicable fees or charges.
  • Payments are processed securely through third-party payment providers. KOOMPASS does not store your payment details.
  • You will receive a confirmation of your booking via email once payment is successful.
  • Prices are quoted in US Dollars and are subject to change until your booking is confirmed.
  • Additional local taxes may apply in select destinations.

5. Deposits and Final Payments

  • To secure your booking, a non-refundable deposit of 30% of the total trip cost is required at the time of reservation.
  • The balance of your payment is due 30 days prior to the trip departure date.
  • If you book a trip within 30 days of the departure date, full payment is required at the time of booking.
  • KOOMPASS reserves the right to cancel your reservation if the final payment is not received by the due date.

6. Cancellation and Refund Policy

  • Cancellations are subject to the following refund schedule per person:
    • 120+ days prior to departure: 100% refund of total trip cost, minus the deposit.
    • Less than 120 days prior to departure: No refund.

If a traveler has made a deposit or fully paid for the trip, KOOMPASS will allow them to reschedule for up to 12 months from the original departure date, subject to availability. The traveler is responsible for covering any price increases, meaning they must pay the difference between the original amount paid (deposit or full payment) and the new trip cost at the time of rebooking.

  • No refunds will be issued for unused portions of a trip once it has commenced.
  • KOOMPASS strongly recommends purchasing travel insurance to protect against unforeseen cancellations.
  • Exceptions to our cancellation policy cannot be made for any reason, including but not limited to: weather, terrorism, civil unrest, pandemics, personal, family, or medical emergencies.

7. Changes to Bookings

  • If you need to change your booking, please contact KOOMPASS as soon as possible.
  • Changes to bookings are subject to availability and may incur additional fees.
  • KOOMPASS reserves the right to charge an administration fee of $ 100 for each change made to a confirmed booking.
  • Changes to the number of travelers in your group may affect the final trip price for each participant.

8. Trip Modifications or Cancellations by KOOMPASS

  • KOOMPASS reserves the right to modify or cancel any trip at any time for any reason determined in our sole discretion, including if the quality of the trip or the safety of travelers may be compromised.
  • In the event of a trip cancellation by KOOMPASS, you will be offered either a full refund of payments made to KOOMPASS or an alternative trip of comparable standard, if available.
  • KOOMPASS is not liable for any expenses incurred in preparation for any canceled trips, such as airline tickets, or for costs incurred due to travel delays, flight cancellations, or illness.
  • In cases of force majeure (including acts of war, terrorism, civil unrest, quarantine, curfew, natural disaster, pandemic, epidemic, and other causes outside of KOOMPASS’s control), KOOMPASS will endeavor to refund payments received, less any unrecoverable expenses already incurred on your behalf.

9. Travel Documents and Requirements

  • It is your responsibility to obtain and maintain valid travel documents required for your trip, including passports, visas, and health documentation.
  • KOOMPASS is not liable for any expenses or costs arising from a traveler being prohibited from entering a country due to inadequate travel documentation.
  • You must comply with all local laws, regulations, and health requirements in the destinations you visit.
  • KOOMPASS may provide information about travel requirements, but it remains your responsibility to verify and secure all necessary documentation.

10. Health and Fitness

  • You must disclose any relevant health information or physical limitations that might affect your participation in the trip.
  • By confirming your booking, you certify that you do not have any physical, mental, or other condition that would create a hazard for yourself or other travelers.
  • KOOMPASS reserves the right to decline any person as a participant on a trip if, in our opinion, that person’s health, physical condition, or behavior may compromise the safety or enjoyment of the trip for themselves or others.
  • KOOMPASS may modify any trip and its associated activities where necessary to accommodate health and safety concerns.

11. Insurance

  • KOOMPASS strongly recommends that all travelers purchase comprehensive travel insurance, including coverage for trip cancellation, medical expenses, evacuation, loss of luggage, and personal effects.
  • Travel insurance is not included in the trip price and is the responsibility of the traveler to arrange.
  • KOOMPASS is not responsible for any costs that may be covered by travel insurance, regardless of whether such insurance was purchased.

12. Liability

  • To the maximum extent permitted by law, KOOMPASS is not liable for any loss, injury, death, damage, delay, inconvenience, or direct or consequential loss of any kind resulting from:
    • The acts, omissions, or negligence of any third-party suppliers, including travel operators, accommodation providers, and transportation companies.
    • Force majeure events, including but not limited to natural disasters, adverse weather conditions, pandemics, civil unrest, or governmental actions.
    • Personal injury, illness, or death from accidents, medical issues, or other causes not within our direct control.
    • Loss or damage to personal property during travel.
    • Changes to travel arrangements or itineraries due to circumstances beyond our control.
  • You agree to release KOOMPASS from all liability to the maximum extent permitted by law.
  • You agree to indemnify KOOMPASS against any claims arising from your violation of these Terms or any laws during your use of our services or participation in any trips.

13. User Responsibilities

  • You agree to respect local laws, customs, and cultural norms during your travels.
  • You agree to behave in a manner that does not cause distress, danger, or annoyance to others.
  • You are responsible for any damage you cause during your trip and may be required to compensate the affected parties accordingly.

14. Privacy

  • KOOMPASS collects and processes personal information in accordance with our Privacy Policy.
  • By using our services, you consent to the collection, use, and sharing of your personal information as described in our Privacy Policy.

 

15. Intellectual Property

  • All content on the KOOMPASS platform, including text, graphics, logos, images, and software, is the property of KOOMPASS or its content suppliers and is protected by copyright laws.
  • You may not reproduce, modify, distribute, or republish any content from the KOOMPASS platform without prior written consent.

16. Termination

  • KOOMPASS reserves the right to terminate your account for any violation of these Terms.
  • Upon termination, you must cease all use of the platform.
  • All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

17. Governing Law

  • These Terms are governed by the laws of the Netherlands and European Union.
  • Any disputes arising under these Terms will be resolved in the competent courts of The Netherlands.

18. Amendments

  • KOOMPASS reserves the right to modify these Terms at any time without prior notice.
  • The current version of the Terms will be available on our website.
  • Your continued use of the KOOMPASS platform after any changes to these Terms constitutes your acceptance of the revised Terms.

19. Severability

  • If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
